Copyright registration is thus not a requirement in order to claim copyright protection. However, if the creator wants to sue infringers from using his or her text, design, material etc. without his permission, he will be required to file a copyright application to register his work with the United States Copyright Office (USCO) first.
Copyright is a set of exclusive rights provided for regulating the use of original work of an author. A Copyright may subsist in a wide range of creative, intellectual, or artistic forms of work from the time the work is created in fixed forms. Copyrightable works include the following categories, literary works, movies, musical composition, audio recordings, paintings, drawings, sculptures, photographs, software, radio and television products. Any nationality or domiciliary of the author’s unpublished works have copyright protection. Published works are protected under certain conditions listed out by the national law of that country.
A copyright application may be filed with the U.S Copyright Office in order to register a claim to a work. The procedure to obtain a copyright registration is as follows. A copyright application may be filed with the USCO with a fee of $30 -35. The USCO will then determine the registrability of the work under copyright law and if there is no conflict or opposition, the work will be registered. The USCO maintains a database of all copyright registrations in the United States and allows users to search these records to prevent infringement of other ownership rights.
