Trademark Registration In IRAN

Filing:
In order to register a trademark in Iran, the following information and documents are required:
Required information:
– Applicant'(s’) full name(s), nationality and address
– Company registration No. (if the applicant is a legal entity)
– A copy of the trademark (not required for word marks)
– The list of the goods and the classes pertaining thereto Required documents:
– Legalized Power of Attorney in the Iranian Consulate
– Certified copy of priority documents legalized in the Iranian Consulate (in case there is any)
– Certified Copy of Company Registration Certificate (if the applicant is a legal entity)
We can file the patent application with the required information and we will have 60 days after receiving the administrative notice for submitting the missing documents. This period can be extended for another 60 days.

Renewal:
The validity of the trademark registration is ten years starting from the filing date. The owner can request to renew the trademark every ten years with payment of the renewal fees. This request shall be submitted six months before the expiration of 10 years. In case of not submitting the renewal request within the due date,
there would be a grace of six months from the expiration date as well as 50% added fee as penalty.
Required documents for filing the renewal of the trademark:
– Legalized Power of Attorney in the Iranian consulate
– A copy of the Iranian TM registration/renewal certificate A Trademark is not registrable in the following cases:
– Not capable of distinguishing the goods or service of one enterprise from those belonging to another enterprise
– Being contrary to the Rules of Sharia, public order or morality
– Being likely to mislead the public or trade centers, in particular as regards the geographical origin of the goods or services to which they belong or their nature or characteristics
– Being identical with, or an imitation of or containing as an element, an armorial bearing, flag or other emblem, a name or abbreviation or initials of the name of, or official sign or hallmark adopted by, any State, intergovernmental organization created under an international convention, unless authorized by the competent authority of that State or organization
– Being identical with, or confusingly similar to, or constituting a translation of, a mark or trade name which is well known in Iran for identical or similar goods or services of another company enterprise
– Being identical or similar to a registered mark or becoming well-known for services that are not similar provided that customarily there is a connection between the uses of the mark and the owner of the already well-known mark and that its registration is likely to damage interests of the owner of the well-known mark
– Being identical to a mark registered in the name of a different proprietor with an earlier filing date or a priority right in respect of the same goods or services or for goods and services that, due to connection or resemblance, is likely to deceive or cause confusion Watch Service In order to protect our clients’ rights, our team offers a unique trademark watch service which consists of English/Persian report in case of any TM infringements along with the deadline to file the opposition, cancellation or taking appeal actions.
Assignment, merger, license agreement, change of name and address:
According to the Law, any changes and modifications, including change of name, address, assignment,
merger and license agreement should be recorded, endorsed on the registration certificate and published in the official gazette for public notice.

– Legalized deed of assignment/ change of name document/ change of address document/ license agreement in the Iranian Consulate
– Valid Iranian registration/renewal certificate for endorsement

Classification of goods and services for TM applications:
For filing a Trademark application, it is required to check the list of goods and services, which the client intends to file, with the Iranian list of goods and services for making sure the requested trademark has not been registered in Iran for the same product or services by the applicant.
